The terms governing GroundGO outdoor-service enquiries, confirmed jobs, mower orders, website use, payment, delivery and customer support in New Zealand.
1. Agreement and scope
These terms apply when you access the GroundGO website, request or accept outdoor services, buy a GroundGO mower, use a quotation, contact support or make a warranty claim. By confirming a service or submitting an order, you agree to the version of these terms presented at that time.
- GroundGO provides lawn mowing, gardening, outdoor tidy-up and clearing enquiries and services
- GroundGO Landscaping accepts fencing, decking, retaining-wall, paving, planting, lawn-establishment and related enquiries in Auckland service areas only
- GroundGO sells the GroundGO M1 and GroundGO M1 Pro mower models
- Specific written quotation, order or warranty terms prevail over a general website description where they are consistent with New Zealand law
2. GroundGO is in trade
GroundGO operates as a New Zealand trader. Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including applicable rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986 and Privacy Act 2020.
3. Website enquiries are not bookings
Submitting a form, photograph, preferred time or postcode does not create a confirmed appointment. A service becomes confirmed only when GroundGO or the assigned provider accepts the address, scope, price and timing in writing or through the agreed booking process.
4. Quotations, estimates and variations
A quotation is based on the information available when it is prepared. An estimate is an indication rather than a fixed price. GroundGO will not misrepresent a quote or invoice and will seek approval before material work outside the agreed scope.
- Quotes may rely on customer descriptions, measurements, images and visible conditions
- Hidden waste, excessive growth, difficult access, unsafe slopes, additional green waste or a larger area may require a revised quote
- A quote may state an expiry date
- Obvious calculation or typographical errors may be corrected before acceptance
5. Customer responsibilities for services
The customer must provide accurate information and lawful access to the property at the agreed time. The customer confirms they are the owner, occupier or person authorised to request the work.
- Disclose pets, locked gates, alarms, tenants, children, fragile items and restricted areas
- Identify known underground or concealed services, irrigation, wires, drains, septic equipment and hazards
- Remove toys, hoses, furniture, animal waste and objects that prevent safe work unless removal is included
- Obtain body-corporate, landlord, neighbour or council permission where required
- Provide a safe location for any agreed waste or equipment handling
6. Site safety and refusal of unsafe work
GroundGO may pause, modify, refuse or reschedule work where conditions are unsafe, unlawful or materially different from those disclosed. This can include severe weather, unstable ground, dangerous slopes, aggressive animals, suspected asbestos, sharps, hazardous waste, unsafe structures or unidentified services.
- A safety decision is not a promise that every hidden hazard will be discovered
- Emergency, arborist, electrical, plumbing, hazardous-substance or specialist work is outside scope unless expressly agreed
- Reasonable attendance or mobilisation costs may apply where a disclosed customer responsibility was not met, if stated before confirmation
6A. Auckland landscaping, boundaries and approvals
A landscaping enquiry or website description is not a building approval, engineering assessment, boundary survey or guarantee that the proposed work can proceed. The confirmed quotation must identify the agreed work, materials and responsibilities.
- The customer must identify ownership and provide reliable boundary, easement and access information
- Council consent, engineering, utility-location, licensed-building or specialist requirements must be resolved where the proposed work requires them
- Hidden ground, drainage, services, contaminated material, unstable soil or undisclosed structures may require a revised method and quotation
- GroundGO will not start work that requires an approval or specialist responsibility until the correct requirement and responsible party are confirmed
7. Weather, access and rescheduling
Outdoor work depends on weather, daylight, ground condition, safe access and local capacity. GroundGO may reschedule where work would be unsafe, damage the property or produce an unreasonable result. The customer must give reasonable notice if access will not be available.
- Same-day service is not guaranteed
- A preferred date is not confirmed until accepted
- Weather delays do not automatically amount to a failure to provide the service
- Any cancellation or attendance charge must be disclosed in the quote or booking terms
8. Lawn and garden outcomes
GroundGO will provide services with reasonable care and skill. Living lawns and gardens respond to soil, drainage, shade, irrigation, pests, disease, weather and customer aftercare; therefore a particular biological result cannot be guaranteed unless it is expressly included in writing.
- Mowing does not by itself cure moss, compaction, drainage, pests, disease or poor soil
- Pruning, weed control, planting and lawn repair may require ongoing maintenance
- General website guides are educational and do not replace a property-specific assessment
9. Green waste, rubbish and prohibited material
Removal applies only to the material described and accepted in the quotation. GroundGO may refuse hazardous, prohibited, contaminated, excessively heavy or undisclosed material.
- Paint, chemicals, asbestos, medical waste, gas cylinders, batteries, fuel and other regulated material require specific handling
- The customer must disclose liquids, sharp objects, soil contamination and unusually heavy items
- Extra volume, weight, sorting or disposal charges require approval before additional work
10. Service records and completion
GroundGO may use arrival, hazard, progress and completion records to administer the job, provide evidence of completion and address quality concerns. The customer should raise a service concern promptly and allow a reasonable opportunity to inspect and, where required by law, remedy the issue.
11. Prices, GST and payment
Unless clearly stated otherwise, consumer-facing prices are in New Zealand dollars and include GST where applicable. Delivery, disposal, remote-area, access or other charges must be disclosed before the customer is committed to pay.
- Payment is due using an offered payment method and by the stated due date
- An order is not accepted merely because a card form or enquiry was submitted
- GroundGO may pause future work for overdue undisputed amounts after reasonable notice
- Any debt-recovery cost must be reasonable, legally recoverable and connected with the overdue amount
12. Product range and model selection
The GroundGO M1 and M1 Pro are separate product variants. The selected variant controls the price, engine model, deck width, blade system, drive configuration, weight and displayed specifications.
- GroundGO M1: NZ$650, genuine Honda GCV145 engine, Auto Choke, 18-inch deck, two blades, hand push and 26 kg
- GroundGO M1 Pro: NZ$1,500, genuine Honda GCVx200 engine, Auto Choke, 21-inch deck, four blades, three-speed self-propelled drive and 35 kg
- Both models are stated as manufactured in China
- The product gallery changes with the selected model so the handle, drive system and blade configuration are shown accurately
13. Product descriptions and images
GroundGO aims to keep descriptions, specifications and images accurate and must have a reasonable basis for product claims. Minor colour, packaging or production-batch differences may occur, but a supplied product must still match its description and applicable consumer guarantees.
- Written variant specifications take priority over generic promotional copy
- Accessories shown but not listed as included are not automatically included
- Screen colour and image scale may vary
- GroundGO will correct a material website error identified before order acceptance
14. Orders and acceptance
A website order is an offer to buy the selected product. GroundGO accepts the order only when payment is successfully authorised, stock and delivery details are confirmed and an order confirmation is issued. GroundGO may reject or cancel an order for a genuine stock, pricing, fraud, delivery or legal reason and will refund money received for an unaccepted order.
15. Delivery, title and risk
Delivery arrangements are governed by the Shipping & Returns Policy and the information confirmed at checkout. GroundGO remains responsible for meeting legal delivery obligations and will not use carrier terms to remove consumer rights that apply against GroundGO.
- The customer must provide a complete and accessible delivery address
- Large-item delivery may require attendance, depot collection or prior contact
- Authority to leave applies only where accepted and legally effective
- Inspect visible packaging damage promptly and preserve reasonable evidence
16. Product assembly, fuel and safe use
A petrol mower must be assembled, fuelled, operated, transported, maintained and stored in accordance with its supplied manuals and warnings. Stop use immediately if the mower appears unsafe or continued use could worsen a fault.
- Never operate without required guards, catcher or discharge components correctly fitted
- Use the specified fuel and oil and keep ignition sources away
- Keep people and animals clear and remove projectiles before mowing
- Do not modify safety controls or commission unauthorised repair work
17. Warranty and consumer remedies
GroundGO provides the stated one-year express warranty for the mower and administers the claim through GroundGO or an appointed third-party service centre. The express warranty is additional to, and does not replace, rights under the Consumer Guarantees Act where that Act applies.
18. Business purchases
Where goods or services are acquired for business purposes, any proposal to contract out of the Consumer Guarantees Act or specified Fair Trading Act provisions must be in writing, between parties in trade and fair and reasonable. No website sentence by itself contracts a consumer out of protected rights.
19. Intellectual property
GroundGO owns or is authorised to use the website design, GroundGO branding, original copy, photography and other content. You may view and print reasonable information for personal purchasing or service purposes, but may not reproduce, scrape, resell, alter or commercially exploit content without permission or another lawful basis.
20. Acceptable website use
Do not attempt unauthorised access, introduce malicious code, interfere with operation, submit false or unlawful material, impersonate another person, misuse forms or use automated extraction in a way that harms GroundGO or other users.
21. Third-party links and services
Links to maps, payment providers, advertising platforms, engine information or other websites are provided for convenience. GroundGO is responsible for its own representations and obligations, but does not control an unrelated third party’s website, availability or independent terms.
22. Liability
Nothing in these terms limits liability where New Zealand law does not permit limitation. Subject to those rights, GroundGO is not responsible for indirect loss that was not reasonably foreseeable or for loss caused by inaccurate customer information, an undisclosed hazard, unauthorised modification, misuse, failure to follow instructions or an event genuinely outside reasonable control.
- This clause is not a blanket exclusion of liability
- Consumer remedies remain available where the Consumer Guarantees Act applies
- Each party must take reasonable steps to limit avoidable loss
23. Complaints and dispute resolution
Contact GroundGO promptly with the quote or order number, relevant dates and a clear description. GroundGO will review the record, may request evidence or inspection and will try to resolve the issue directly. Customers may also use available New Zealand dispute and regulatory processes.
24. Governing law, severability and changes
These terms are governed by New Zealand law and New Zealand courts have jurisdiction, subject to any right to use a tribunal or other forum. If part of these terms is unenforceable, the remaining terms continue. Changes apply prospectively from the stated effective date unless law or an agreed contract requires otherwise.
